February 2026 Newsletter: Recap of the Latest Immigration News

This month, there are not many major immigration policy changes to share. However, there are some important recent updates and reminders that may affect your case. Please take a moment to read the information below.

If you have questions about how any of these updates apply to your situation, our office is here to help.

DHS Shutdown: Most Immigration Services Continue

A partial government shutdown is underway after lawmakers were unable to reach a funding agreement for the Department of Homeland Security (DHS). Even so, most day-to-day immigration processing is still moving forward.

Here is what you need to know:

  • U.S. Citizenship and Immigration Services (USCIS) is primarily funded by filing fees, not taxpayer dollars. USCIS remains open and is continuing to process applications.
  • If you have a scheduled appointment or a pending application, do not assume it has been affected. Check your notices and contact our office if you have concerns.

Immigrant Visa Processing Pause Continues

As we reported in last month’s newsletter, a pause on immigrant visa processing remains in effect for nationals from 75 countries.

This pause only affects people applying for immigrant visas at U.S. consulates and embassies abroad. If you filed your green card application while living in the United States, your case continues as normal.

In Case You Missed It: Recent USCIS Updates

If you have not reviewed recent USCIS changes, here are important reminders that may affect your application:

Biometric Photos Must Be Less Than 3 Years Old

USCIS now requires that biometric photos be less than 36 months (3 years) old. If your last biometric photo was taken more than 3 years ago, you will need to attend a new biometrics appointment.

Please note: If you are filing a green card application (Form I-485) or a naturalization application (Form N-400), you will always be required to attend a biometrics appointment, no matter when your last photo was taken.

Electronic Payments Required for All USCIS Filings

As of October 28, 2025, USCIS accepts electronic payments only. You must pay filing fees using one of the following options:

  • Direct bank debit using Form G-1650
  • Credit or prepaid card using Form G-1450

Using an incorrect payment method can result in your application being rejected or delayed. Make sure you use the correct form and verify your funds before filing.

Automatic Work Permit Extensions Have Ended

Automatic work permit extensions are no longer available. Here is what this means for you:

  • Applications filed on or after October 30, 2025 do not receive the 540-day automatic extension for Employment Authorization Document (EAD) renewals.
  • If your work permit expires before USCIS approves your renewal, you must stop working.
  • You may file for renewal up to 180 days (6 months) before your expiration date. Filing early is strongly recommended.

Please check your EAD expiration date as soon as possible. Contact our office if you have questions about timing or documentation.

Keep Your Address Updated with USCIS

USCIS sends important notices, interview appointments, and decisions by mail. If your address is out of date, you may miss critical information about your case.

Please note you must update your address within 10 days of moving. You can do this online at https://www.uscis.gov/addresschange.

Applied for Naturalization Recently? How to Prepare for Your Interview

Quick Tip: If you applied for naturalization on or after October 20, 2025, you will be tested on the 2025 Civics Test — not the older version. The 2025 test is more challenging, so it is important to study the right materials before your interview.

Here is what is different about the 2025 Civics Test:

  • You will be asked up to 20 questions (instead of 10)
  • You must answer at least 12 correctly to pass
  • Questions come from a pool of 128 possible questions

USCIS has official study materials available at: uscis.gov — 2025 Civics Test Resources. We encourage all recent applicants to review these materials before their interview date.

If you are not sure which test applies to you, contact our office and we can help you confirm and prepare.
