A Recap of the Latest Immigration News

Appeals Court Debates Texas’ Standing in DACA Lawsuit

The legal battle over the Deferred Action for Childhood Arrivals (DACA) program continues. On October 10, a three-judge panel from the Fifth Circuit Court of Appeals heard arguments regarding Texas’ legal standing to challenge DACA. Texas claims that the program, which offers deportation relief and work permits to nearly 600,000 recipients, increases the state’s public service expenses. The Biden administration argues that Texas has not demonstrated direct financial harm from DACA.

Judges were split on key issues, including whether Texas has standing to sue and if the court’s ruling should affect all states or only Texas.

The debate highlights the ongoing uncertainty for DACA recipients, as the program remains under legal scrutiny.

Applicants with DACA expiring in the next 8-12 months should be applying to renew as soon as possible.

Federal Judge Strikes Down Biden’s “Parole in Place” Program

In a significant ruling, a federal judge in Texas permanently blocked the Biden administration’s “parole in place” program. This program provided undocumented immigrants married to U.S. citizens with an opportunity to obtain parole, work authorization, and a pathway to residency.

The judge ruled that the program exceeded the administration’s authority, halting all application processing. U.S. Citizenship and Immigration Services (USCIS) has announced it will no longer accept or process related forms and will publish additional information about fees for affected applicants.

Individuals impacted by the decision may need to explore alternative pathways to address their immigration status. At this time, it is unknown if the Biden administration will be appealing this decision.
