August 2024 Newsletter: A Recap of the Latest Immigration News

A Recap of the Latest Immigration News

August 2024 has brought significant updates in the US immigration policies, shaping the path forward for many. From the launch of a program for undocumented spouses of US citizens to the shifting policy proposals, there are important changes that people need to stay updated on.

Here’s a closer look at the most recent updates and what they could mean for you.

Important Update on the Keeping Families Together Program

As we’ve covered in previous newsletters, the Biden administration introduced the “Parole in Place” policy (also known as the Keeping Families Together Program), which offers a pathway to lawful status for undocumented spouses of U.S. citizens. This policy allows these individuals to remain in the United States without fear of deportation while applying for a green card.

The application process for this program opened on August 19, 2024. However, it’s important to note that on August 26, 2024, a federal judge issued a temporary stay (i.e. a “pause”) on the program’s implementation following a lawsuit filed by Texas and 15 other states. This means that while U.S. Citizenship and Immigration Services (USCIS) can continue to accept applications, they cannot approve them during this 14-day period, which may be extended.

What This Means for Applicants:

  • You can still apply! USCIS is still accepting applications, and doing so now may be beneficial if the stay is lifted.
  • No penalties for applying now. If you apply during this period, your application will be considered once the stay is lifted.
  • Stay informed. The situation is evolving, so staying updated on any changes to the program is crucial.

Eligibility Criteria:

  • Have been continuously present in the United States for at least 10 years as of June 17, 2024.
  • Have a legally valid marriage to a U.S. citizen as of June 17, 2024.
  • Have no disqualifying criminal convictions.

Essential Documents Needed:

  • Proof of a legally valid marriage to a U.S. citizen, established by June 17, 2024.
  • Documentation for proof of identity, including any expired documents.
  • Evidence confirming your spouse’s U.S. citizenship.
  • Records demonstrating your continuous presence in the United States for at least 10 years, up to June 17, 2024.

What to Expect Ahead of November Elections

With the November elections fast approaching, immigration remains a key issue, especially following the announcement that President Joe Biden will not seek re-election. With the race wide open, candidates from both parties are proposing a variety of policies.

On the Democratic side, candidates emphasize the importance of compassionate policies that prioritize family unity and provide a fair chance for undocumented immigrants to gain legal status. In addition to the aforementioned PIP policy, there’s a strong push to protect vulnerable populations, including those brought to the US as children under Deferred Action for Childhood Arrivals (DACA).

Democratic candidates also advocate for reforms that streamline the asylum process, making it more accessible and humane for those fleeing persecution. They propose expanding humanitarian visas and increasing support for immigrant communities to integrate successfully into American society.

Conversely, Republican candidates are pushing for a more stringent approach to immigration, focusing on border security and the enforcement of existing laws. Alongside increasing funding for border enforcement and mandating E-Verify, there is also a call for tightening the criteria for asylum seekers and reducing the number of visas issued for family reunification.

With such contrasting views on immigration, the outcome of the November elections could shape the future of US immigration policy for years to come. Voters concerned about immigration should closely follow the candidates’ platforms and be prepared to make informed decisions at the polls.
